California Lemon Law Experts in San Diego
The California Lemon Law is designed to protect consumers that purchase new vehicles including cars, trucks, SUVs, motorcycles and RVs/motor homes. There are also many other Consumer Protection laws that apply to consumer product purchases. There are also options for used and leased vehicles and as the best lemon law lawyer in San Diego, we can help you explore your options if you feel you have a lemon law case.
What does the California Lemon Law Cover?
The lemon law covers new motor vehicles such as cars, trucks, motorcycles, SUVs and RVs/motor homes that have a gross vehicle weight that is less than 10,000 pounds. In regards to an RV/motor home, it also covers the chassis, chassis cab and that portion of a motor home devoted to its propulsion. One thing that it does not cover on an RV/motor home though is any portion designed, used or designed primarily for human habitation.
However, if a consumer continually has problems with a motorcycle, a used car purchased with a manufacturer’s new car warranty, a pre-owned certified vehicle, the coach portion of an RV/motor home, a truck with a gross vehicle weight of over 10,000 pounds, we may still be able to help under California case law and other relevant state and federal statutes.
According to the California Lemon Law the manufacturer may have to abide by the following:
- Pay for the consumers’ attorney’s fees and costs
- Provide adequate repair facilities in California
- Be allowed a certain number of repair attempts to fix the problem with the defective vehicle
- Offer the consumer a replacement or a refund (buy back) minus any trouble-free use value
- Ensure repairs do not take longer than 30 days
If the manufacturer of a vehicle that has a warranty is not able to repair the vehicle after a reasonable number of repair attempts, then it must buy back or replace the vehicle. It must also pay the consumer’s incidental and consequential damages as well as the consumer’s attorney’s fees and costs. Reasonable number of attempts may be understood in several ways. It typically varies and depends on the seriousness of the defect. Safety defects on a vehicle typically require fewer repair attempts than non-safety related defects.
Your Rights as a Consumer
It is important to note that the California Lemon Laws are very powerful. The laws are in place to protect the consumer from defective products and to provide an avenue to monetary compensation when defects occur.
The California lemon laws provides the following types of remedies:
- Payment of the consumer’s attorney’s fees and costs
- Replacement of the defective vehicle
- Cash settlement
- Repurchase (buy back) of the defective car
If you are in a situation where you believe you may have purchased a lemon vehicle, make sure to protect your rights and look into possibly starting a lemon law case. Once you begin the process, you may demand to be compensated for the damages that you are entitled to under the law. Even if the manufacturer is offering to buy back the vehicle, you should have a lemon law lawyer on your side to negotiate the terms of the offer.
Keep The Following in Mind When Deciding to Start a Lemon Law Case
If your vehicle is a lemon, we can force the manufacturer to buy-back your vehicle with a refund of all…
- √ License And Registration Fees
- √ All Past Monthly Payments, Including Down Payment
- √ Repair Costs
- √ Towing Costs
- √ Out-Of-Pocket Expenses
- √ You May Even Be Entitled To A Civil Penalty
Consumers often want to know how to determine whether they have a lemon law claim. The short answer to that question is, it’s complicated. We have years of relevant training and experience that allows us to make that determination. Rather than have you try to figure it out for yourself, give us a call and let’s talk it through. We want to hear your story. More importantly, we want to help you. If we can, we definitely will. Allow us that opportunity.
We have a few specific words of caution. Do not get hung up on the “30-day,” “2 or more times,” “4 or more times,” “safety,” “18 month,” and “18,000 mile” rules. These are rules that provide very broad guidelines, and there are countless exceptions to them. Not a single one of these rules has to apply to your car in order for it to qualify as a lemon. Even used cars can qualify under the lemon law. If your car, for some reason, does not qualify under the lemon law, there may be something about the sale of the car that was fraudulent. We have the training and experience to spot fraud as well.

I was ecstatic after buying a new car but began having problems with it shortly thereafter. We contacted the dealership where we purchased the vehicle and after a while we felt that it was becoming a continuous battle of back and forth and nothing was getting resolved. The vehicle had been taken in to get serviced and we took it back to the service department several more times. It was a frustrating ordeal. Finally, we decided to contact Scott Law Group. Best decision I could have made. Within a few months we had a buyback offer from the manufacturer. Christian and his staff took care of us in less time than we had expected. This legal team is awesome and I would definitely recommend them for any Lemon needs.
